Blogger Contest Rules

Introduction:

OldHouseWeb.com, a website owned and operated by QuinStreet, Inc. (“QuinStreet” or “Sponsor”) is offering the “OldHouseWeb.com Blogger Contest: Halloween Edition” (the “Contest”). Entry constitutes acceptance of these Official Rules and the terms of use and privacy policy of OldHouseWeb.com.

NO PURCHASE IS NECESSARY TO ENTER OR WIN. CONTEST VOID WHERE PROHIBITED BY LAW.

Eligibility:

Contestants must be at least 18 years of age at the time of entry and legal residents of the 50 United States and the District of Columbia. Void in Puerto Rico and where prohibited by law or regulation. The Contest is subject to all applicable federal, state and local laws. Employees of QuinStreet, Inc. and its subsidiaries, affiliated companies, agents, and such employees’ immediate family (defined as parents, spouse, children, siblings and grandparents), and all those with whom such employees are domiciled, are NOT eligible to participate in the Contest.

Entry Requirements:

To enter the Contest, prepare an original blog post (fewer than 350 words in length) on the topic of ghost stories and old houses. Then, either (1) submit your blog post by emailing the entry to editorial@oldhouseweb.com, including a contact name and email address, or (2) if you are an OldHouseWeb.com forum member, you may submit your blog post by posting it in the “Haunted house stories, please share!” forum thread (http://www.oldhouseweb.com/forums/viewtopic.php?f=2&t=20580&p=220494&hilit=haunted#p220494). All contestants must submit their blog posts between 12:00:01 a.m. Pacific Time (“PT”) on October 5, 2010 and 11:59:59 p.m. PT on November 5, 2010 (the “Entry Period”). If any group of individuals chooses to collaborate on a blog entry, then they are required to designate one individual to enter the Contest who will be responsible for obtaining any required signatures from the group and, if the group is a winner, who will accept the prize on behalf of the group. Sponsor is not liable for any disputes between collaborators related to any blog entry.

Blog posts entered in the Contest must be submitted in English. The contestant certifies that (a) he or she owns the materials submitted to OldHouseWeb.com for the Contest and that such materials are the contestant’s original creation, created solely by the contestant, without any restrictions or limitations on the contestant’s right to submit or QuinStreet’s right to use the entry; (b) by entering into the Contest, the contestant is not contravening any provisions of the Copyright Act, including the educational fair use provision; (c) the entry does not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights; (d) none of the material in the entry is offensive, inappropriate, indecent, obscene, hateful, or tortuous (including containing material that promotes bigotry, racism or harm against any group or individual or promotes any form of discrimination); (e) the entry does not contain any brand names or trademarks; and (f) the entry does not contain material that is in violation of any law or regulation.

QuinStreet reserves the right to disqualify any entry it deems to be inappropriate, offensive or is not in keeping with QuinStreet’s image, in its sole discretion.

Once a contestant has submitted a blog post for the Contest, such contestant agrees that the blog post will be considered final and Sponsor shall own the entry submitted (including all rights embodied therein) and that Sponsor and its designees may exploit, edit, modify, display and distribute the entry and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to contestant or any third party.

Judging and Selection of Winners:

All approved blog post entries will be posted to the OldHouseWeb.com Blog to be viewed and rated by members of the general public. Any entry that contains material which is unsuitable (as determined by Sponsor), does not meet eligibility requirements, does not meet criteria as set forth in these Official Rules or is in violation of the OldHouseWeb.com terms of use or privacy policy will be disqualified. Contestants may promote their blog posts to increase page views and ratings.

Of the blog posts entered in the Contest, the blog posts selected to be published to the OldHouseWeb.com Blog (http://www.oldhouseweb.com/blog/) will be eligible for one of five weekly prizes (to be announced each Friday during the Contest Entry Period, starting on October 8, 2010) and/or one grand prize (to be announced on November 12, 2010). Eligible blog posts entered before the conclusion of the Entry Period will be viewed by a judging panel consisting of employees of Sponsor (the “Judging Panel”). One grand prize winner will be selected by the Judging Panel on the following criteria: creativity, topic relevance and popularity on the OldHouseWeb.com Blog.

QuinStreet reserves the right not to award a prize in the event that it receives an insufficient number of eligible entries that meet the minimum judging criteria, as determined by QuinStreet in its sole discretion. QuinStreet will supervise the voting and judging. Contestants agree to be bound by the decisions of the judges and the voting public, whose decisions are final.

Winner Notification:

The weekly winners will be announced each Friday beginning on October 8, 2010 during the Contest Entry Period, the grand prize winner will be announced on November 12,, 2010. The winners will be notified by email. Potential winners must respond to their notification within 7 days of receipt or they will be disqualified. Potential winners will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within 14 days of issuance of notification or they will be disqualified. Noncompliance with the foregoing, these Official Rules, Sponsor’s inability to contact a potential winner within a reasonable time period or prize notification returned as non-deliverable, may result in disqualification and, at Sponsor’s discretion, a runner-up may be notified.

By accepting any prize, the winner grants QuinStreet and its designees the right to use his/her name, city and state of residence, likeness and biographical information in any and all media for any purposes throughout the world in perpetuity, without additional compensation, notice or permission, unless prohibited by law, and the winner agrees to provide Sponsor with his/her blog post entry in its original format in order for the blog post to be used in future promotion or other activities.

The list of winners shall be displayed at http://www.oldhouseweb.com/blog/ each Friday during the Entry Period beginning October 8, 2010 and on November 12, 2010. You may also request the name of the winner by sending a self-addressed, stamped envelope to be received by August 12, 2010 to: QuinStreet, Inc., c/o OldHouseWeb.com Blog Contest: Halloween Edition, 1051 E. Hillsdale Blvd., Suite 800, Foster City, CA 94404.

Prizes:

The grand prize winner of the Contest will win a $500.00 Lowe’s gift card (Approximate Retail Value: $1,000). The five weekly winners of the Contest will each win a $100.00 Lowe’s gift card (Approximate Retail Value of each card: $100.00). Total Approximate Retail Value is $1,000.00. Lowe’s is not a sponsor of the Contest. All federal, state and local taxes and any other costs and expenses not specifically stated herein as being awarded are the winners’ sole responsibility. No transfer, assignment, cash redemption, or substitution of prize except by QuinStreet who may substitute a prize with one of equal or greater value, at its sole discretion. All prize details are at the sole discretion of QuinStreet.

Any entries not eligible for any reason will be disqualified from winning any award or prize and ineligible entries may be deleted from OldHouseWeb.com. Any entry that is awarded a prize and is later determined to have been ineligible, will be required to return any prize of monetary or material value within 7 days upon notification of disqualification and ineligibility.

Limitation of Liability:

QuinStreet and its affiliates will not be responsible for late, lost, stolen, misdirected, damaged, incomplete, or illegible entries; or entries that are lost due to computer, Internet, or electronic malfunction. QuinStreet reserves the right to cancel or modify the Contest and award the prize through an alternate means if fraud or technical failure compromises the integrity of the contest, as determined by it in its sole discretion. Contestants agree that QuinStreet, its promotion partners, affiliates, agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this Contest or acceptance of or use or misuse of a prize or parts thereof. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered.

Governing Law; Venue:

This Contest will be governed by the laws of the State of California without reference to its choice of law principles. The contestants agree to submit to the exclusive jurisdiction of the state courts located in San Mateo County in the State of California and the federal courts located in the Northern District of California, with respect to disputes hereunder.
